For clients and transactions conducted in Reno, Nevada, the terms comply with Nevada business law, including late fee limitations and commercial protections. For clients in California, these terms follow applicable California civil code standards, including reasonableness of late fees and required transparency in business transactions.

Gym Medics – Invoice Payment Terms & Late Fee Policy

1. Payment Terms

All invoices issued by Gym Medics are due and payable within 7 calendar days of the invoice date, unless otherwise stated in writing.

2. Grace Period

A 7-day grace period will be granted after the initial 7-day payment window. No late fees will apply during this grace period.

3. Reminder Schedule

To ensure transparency, Gym Medics will send payment reminders to the client:

• Day 3 after invoice due date

• Day 7 after the first reminder

• Final reminder on Day 14 after due date

4. Late Fees

If payment has not been received by the end of the 14th day (7 days due + 7-day grace), a late fee of 5% of the outstanding balance will be applied.

For every additional 30-day period that the invoice remains unpaid, an additional 5% fee will be applied to the original outstanding balance, unless otherwise capped by law.

5. California Law Compliance

This policy aligns with the laws and guidelines in the State of California, including standards requiring that late fees must be:

• Reasonable, and

• Reflective of the costs incurred due to late payment (e.g., administrative overhead, disruption of cash flow).

There is no statutory limit on late fees in California for business-to-business transactions, but Gym Medics maintains fees that are fair and consistent with industry standards.

6. Nevada Law Compliance

This policy aligns with the laws and guidelines in the State of Nevada, including standards requiring that late fees must be:

• Reasonable, and

• Proportional to the disruption or cost caused by late payment (e.g., administrative burden, delay in service planning).

Nevada law generally permits late fees up to 5% per month on overdue invoices. Gym Medics ensures its fee structure remains compliant by applying 5% every 14 days without exceeding this monthly cap, and by providing a grace period that exceeds the state’s minimum requirement.

7. Suspension of Services

If an invoice remains unpaid for more than 30 calendar days past its due date, Gym Medics reserves the right to:

• Suspend all scheduled or in-progress services, and/or

• Terminate the service relationship without further obligation, and/or

• Refer the matter to collections.

8. Collection and Legal Costs

The client agrees to be responsible for any reasonable costs incurred by Gym Medics in collecting overdue payments, including but not limited to collection agency fees, court costs, and attorney’s fees.

9. Client Responsibility

Clients are responsible for maintaining accurate billing and contact information. If a failed payment occurs due to outdated or incorrect details, the account will still be considered past due, and late fees will apply.

Refund Policy:

At Gym Medics, customer satisfaction is important to us. However, due to the nature of our business and products, all sales are considered final unless otherwise explicitly stated in writing at the time of sale.

Eligibility for Return

In rare cases where returns are authorized, the following conditions must be met:

The item must be in unused, unpackaged condition, in its original packaging, and in the same condition you received it.
You must provide a valid receipt or proof of purchase.
You must contact us first at service@thegymmedics.com to request a return authorization. Items returned without prior approval will not be accepted.

Shipping and Restocking Fees

If your return is accepted, you are responsible for returning the item to us.
If the item was originally shipped to you, return shipping costs are your responsibility.
A 10% restocking fee will be applied to all authorized returns, along with deductions for:
- Original shipping charges, and
- Any applicable order processing or transaction fees.

Non-Returnable Items

We do not accept returns on the following:

Items marked “final sale”
Gift cards
Used or installed items, unless there is a proven manufacturer defect

Damaged, Defective, or Incorrect Items

Please inspect your order upon delivery and contact us within 3 business days at service@thegymmedics.com if:

The product is damaged in transit
You receive a defective item

We will evaluate the issue and, if verified, arrange a replacement or refund at our discretion.

Exchanges
